By using the MapperTool online software (www.mappertool.com), the user accepts the provisions set out in these Terms and Conditions (T&C). The service is provided by AirScan Kft. as a software service provider that offers data processing.

MapperTool is a cloud-based, subscription SaaS (Software as a Service) platform that enables the automatic photogrammetric processing of drone imagery.

The user may upload raw data (drone images, photogrammetric imagery) that the system automatically processes into outputs such as orthophoto, DTM (Digital Terrain Model), DSM (Digital Surface Model), 3D point cloud, NDVI and thermal orthophoto. On the MapperTool interface the user can view the results on a map, export them, and perform measurements (for example distance, area and height).

The MapperTool service qualifies as a digital content and digital service that does not provide a physical product, but an online processing result.

The contract is concluded between the user and AirScan Kft. through registration on and use of the www.mappertool.com website.

MapperTool is available in Free, Basic and Pro subscription tiers. The scope, limits (for example the number of images/projects and the availability period of projects) and the current prices of each tier are published on www.mappertool.com, where up-to-date pricing and any discounts are always available.

To use the service, the user must have a valid e-mail address, internet access and a browser that is compatible with the MapperTool system.

Paid subscriptions are billed on a monthly or annual basis and renew automatically at the end of each billing period.

The user may cancel the subscription at any time. After cancellation the service remains available until the end of the period already paid for, and no further amount is charged. Cancellation does not entitle the user to a refund of amounts already paid (see the Refund and Withdrawal Policy).

Payment is made in advance through the Stripe system.

The subscription fee is charged according to the selected tier and billing cycle, as published on www.mappertool.com.

The prices displayed do not include VAT. VAT is added to the price in accordance with the legislation of the relevant country.

The invoice is issued automatically, and the user can download it from the Profile / Orders menu.

As the MapperTool service is a digital content and digital service that is made available immediately, the consumer, by subscribing, gives express prior consent to the immediate provision of the service and acknowledges that they thereby lose the 14-day right of withdrawal under Directive 2011/83/EU and Government Decree 45/2014 (II.26.).

Amounts already paid for a subscription period are non-refundable. This does not affect the mandatory rights of consumers under applicable law, or the cases of provider-side technical failure set out in the Refund and Withdrawal Policy.

After a valid subscription is active, the user may upload data and start processing. The system creates the digital outputs based on the uploaded data.

Warning:

The accuracy of the final results depends strongly on the quality, resolution and correct georeferencing of the uploaded data. The data generated by the MapperTool software are for information purposes only and do not constitute an official measurement report or certificate. The Service Provider does not assume liability for the accuracy or quality of the processed data.

The MapperTool service provider is not liable for:

• inaccuracies resulting from errors, deficiencies or georeferencing discrepancies in the uploaded data,
• decisions, professional conclusions or economic damage arising from the data,
• temporary service interruptions (maintenance, force majeure, network failure).

The service provider makes every effort to ensure the secure storage of data and the availability of the service, but does not guarantee 100% availability.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for intentional or grossly negligent conduct, or under mandatory consumer protection rules.

MapperTool processes data in accordance with the provisions of the EU GDPR (2016/679). The details of data processing, including the controller and processor roles for uploaded content, are described in the Privacy Policy.

The MapperTool system may be temporarily suspended for periodic maintenance or updates. These periods are communicated in advance by e-mail notification and on MapperTool’s official social media channels.

This contract is governed by Hungarian law. Any disputes between the parties fall under the jurisdiction of the competent court in Budapest.

This does not deprive a consumer of the protection of the mandatory provisions of the law of their country of residence, nor of the right to bring or defend proceedings before the courts of their place of residence where mandatory EU consumer rules so provide.

The service provider acknowledges every enquiry within 72 hours.

The data generated during processing (orthophotos, models, point clouds, measurements, reports) become the property of the user and may be used and shared freely. The user retains all rights to the raw data they upload and grants the Service Provider a limited licence to process this data solely for the purpose of providing the service.
